Welcome to DearSong! These Terms of Service ("Terms") govern your use of dearsong.com and the personalized song creation services we provide.

By accessing our website or placing an order, you agree to these Terms. Please read them carefully before making a purchase.

1. Our Services

DearSong creates personalized songs inspired by the stories, memories, and details you share with us.

Each song is custom-made based on the information and preferences provided during the ordering process. Because every song is uniquely created, individual results may vary in musical style, vocals, pronunciation, and arrangement.

Our products are delivered digitally. No physical items are shipped unless explicitly stated otherwise.

2. Orders and Payments

All prices are displayed on our website and confirmed before checkout. Payments are processed securely through third-party payment providers.

By placing an order, you confirm that the information you provide is accurate and that you are authorized to use your selected payment method.

Because work on personalized songs may begin immediately after an order is placed, orders generally cannot be cancelled once production has started. However, all eligible purchases remain covered by our 30-Day Satisfaction Guarantee described below.

3. Delivery and Fulfillment

We begin processing your song promptly after your order is placed and aim to complete orders as quickly as possible.

Depending on the options available at checkout, delivery may include:

• Express Delivery: As quickly as 30 minutes.
• Standard Delivery: Typically within 48 hours.

The delivery options and estimated fulfillment times displayed at checkout at the time of purchase will apply to your order.

We frequently complete songs ahead of schedule. However, delivery times may vary depending on order volume, production requirements, and unforeseen technical circumstances.

If a significant delay occurs, we will make reasonable efforts to notify you and resolve the issue.

How you'll receive your song:

Your completed song will be delivered via email and/or made available through your order page.

Songs are provided as downloadable MP3 files and can also be streamed directly on our website through a private, shareable link.

Anyone with access to your private song link may be able to listen to it, so please share it thoughtfully. We recommend downloading and saving your MP3 file for personal safekeeping.

4. Song Revisions

We want you to love your finished song.

If something doesn't sound quite right, you can contact us to request changes. We offer revision options, including unlimited revisions where included with your purchase.

Revisions may address issues such as lyrics, pronunciation, missing details, musical style, vocal preferences, or other aspects of the original song.

Every new version is uniquely created, so details such as exact pronunciation, timing, or instrumentation may shift between versions.

Revisions are intended to improve your original song rather than create entirely new songs based on unrelated stories or requests.

We encourage customers to provide specific feedback so we can make the most meaningful improvements.

5. Our 30-Day Satisfaction Guarantee

Your satisfaction matters to us, and we want you to feel confident when ordering a personalized song.

Because every song is custom-made specifically for you, it cannot be resold or repurposed for another customer. Although personalized digital products are generally not suitable for returns, we voluntarily offer a 30-Day Satisfaction Guarantee as a commitment to our customers.

How our guarantee works:

If you're unhappy with your song, please contact us and explain what you'd like changed.

Before requesting a refund based on dissatisfaction with the song, we ask that you give us a reasonable opportunity to address your concerns through revisions.

If, after working with us in good faith through reasonable revision attempts, you're still not satisfied with the result, we'll provide a refund under our 30-Day Satisfaction Guarantee.

To qualify, you must contact us within 30 days of your original song's delivery. If the revision process extends beyond that period, your request will remain eligible provided you contacted us within the original 30-day window.

Approved refunds will be returned to your original payment method. Processing times may vary depending on your payment provider.

This guarantee does not limit any rights or remedies available to you under applicable consumer protection laws.

6. Intellectual Property and Personal Use

Your personalized song is provided for personal, non-commercial use only.

Once your purchase is complete, you receive a non-exclusive, non-transferable license to download, listen to, and share your song for personal enjoyment.

You may share your song privately with friends and family, play it at personal events, or share it on personal social media accounts for non-commercial purposes.

You may not, without our prior written permission:

• Sell, resell, or commercially distribute your song.
• Release or distribute your song through commercial music streaming or distribution services.
• Monetize the song through advertising, licensing, or other commercial activities.
• Claim exclusive ownership of the underlying music or recording.
• Transfer or sublicense commercial rights to another individual or business.

All rights not expressly granted remain reserved by DearSong and any applicable rights holders.

Your original stories, memories, and other content you submit remain yours. By submitting content, you grant us permission to use and process it as necessary to create, revise, and deliver your personalized song.

We do not guarantee that any particular song will qualify for copyright registration or exclusive copyright protection.

7. Customer Responsibilities

You agree to provide accurate information when placing an order and to submit only content that you have the right to share.

You must not use our services to create unlawful, infringing, threatening, or otherwise harmful content.

We reserve the right to decline or cancel requests that violate these Terms or applicable laws. If we cancel a paid order before delivery for these reasons, we will review any applicable refund obligations.

8. Email and SMS Communications

By placing an order, you agree that we may contact you using the contact information provided for purposes related to your purchase, including order confirmations, delivery updates, revision requests, and customer support.

Marketing Communications

We may also send promotional emails in accordance with applicable law. You can unsubscribe from marketing emails at any time using the unsubscribe link provided.

If you separately opt in to receive promotional text messages from DearSong, you agree to receive recurring marketing and promotional SMS messages at the phone number provided, including automated messages where applicable.

• Consent to marketing text messages is not required to make a purchase.
• Message frequency may vary.
• Message and data rates may apply.
• Reply STOP to unsubscribe from promotional text messages at any time.
• Reply HELP for assistance, or contact our support team.

We respect your communication preferences and will honor opt-out requests in accordance with applicable law.

Occasional delays, interruptions, or technical issues may occur.

To the fullest extent permitted by applicable law, DearSong is not responsible for indirect, incidental, or consequential damages arising from the use of our services.

Our total liability relating to a particular order will not exceed the amount paid for that order, except where applicable law requires otherwise.

Nothing in these Terms excludes rights or remedies that cannot lawfully be limited.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, business practices, or legal requirements.

Updated Terms will be published on this page with a revised effective date. Changes will not retroactively reduce the rights or guarantees applicable to purchases already completed.
